{"id":22741,"date":"2018-06-15T14:59:51","date_gmt":"2018-06-15T12:59:51","guid":{"rendered":"https:\/\/ladymary.com\/2018\/06\/15\/cannabis-e-legale-voragine-legislativa-2\/"},"modified":"2026-05-26T11:51:21","modified_gmt":"2026-05-26T09:51:21","slug":"cannabis-is-legal-but-the-legislative-gap-remains","status":"publish","type":"post","link":"https:\/\/ladymary.com\/en\/2018\/06\/15\/cannabis-is-legal-but-the-legislative-gap-remains\/","title":{"rendered":"CANNABIS IS LEGAL, BUT THE LEGISLATIVE GAP REMAINS"},"content":{"rendered":"<p>Is Cannabis legal in Italy?<\/p>\n<p>With the entry into force of <a href=\"http:\/\/www.gazzettaufficiale.it\/eli\/id\/2016\/12\/30\/16G00258\/sg\">agricultural law 242\/2016<\/a>, which regulates the scope and extent to which cannabis sativa can be used, the black market for illegal marijuana has, in some ways, been bypassed in favor of a \u201csustainable\u201d market. However, the institutions and the State above all falter and struggle to get out of a limbo in which the key word is taboo.The aforementioned law, in fact, was promulgated &#8220;for the support and promotion of the cultivation and supply chain of hemp, as a culture capable of contributing to the reduction of land consumption and desertification and the loss of biodiversity&#8221;, therefore with a purpose that we would dare to define as &#8220;eco-sustainable&#8221;.The central focus, however, is the one that forces us to face reality without buts and without ifs. In fact, if on the one hand, the aforementioned discipline has given the opportunity to many entrepreneurs to invest private capital in the cultivation of cannabis sativa with important guarantees, on the other hand it places the limit of <strong>consumption only for collecting purposes<\/strong>. Retracing the legislative process, we can certainly state that agricultural entrepreneurs have benefited from law 242\/2016;in fact, while previously the THC limit allowed for free and legal cultivation was 0.1% (which led, after numerous checks by the competent forces, to the destruction of countless cultivated fields, in which a higher percentage of tetrahydrocannabinol was found), <strong>today the limit varies from 0.2 to 0.6%<\/strong>: an achievement for those who have attempted this undertaking.<\/p>\n<p><strong>Therefore we can today state that cannabis is legal in Italy if its THC limit does not exceed 0.6% and if it is sold and purchased exclusively for technical and collecting purposes.<\/strong><\/p>\n<p>Furthermore, its entry into force has given rise to a legal business and the opening of many &#8220;grow shops&#8221;, i.e. activities aimed at the cultivation and marketing of <a href=\"https:\/\/ladymary.com\/categoria-prodotto\/infiorescenze-di-cannabis-legale\/\">hemp inflorescences<\/a>. The question that arises spontaneously and that requires us to reflect on the subject of the &#8220;Maria&#8221; is one: how much is there really purchased for collecting purposes by consumers? The use permitted by law is of a technical nature, i.e. the purchase of &#8220;collectible inflorescences&#8221; by users, but the numerical reality says something else.In fact, according to some investigations, cannabis sativa flowers are purchased by the largest portion of consumers <strong>recreational purpose<\/strong> and for <strong>combat the symptoms of pathologies related to stress or depression<\/strong>, having CBD, contained in cannabis light, <strong>relaxing properties<\/strong>.<\/p>\n<p>Regarding the roles of the retailer and the consumer, a distinction must be made regarding the use of inflorescences.<\/p>\n<h2><strong>Is cannabis legal for retailer?<\/strong><\/h2>\n<p>In fact, as far as the retailer is concerned, the latter can purchase and sell inflorescences, solely and exclusively, for collector&#8217;s use pursuant to the aforementioned law. Furthermore, regarding the conduct to be followed, it is not permissible for the retailer to give advice to the consumer on the different use of flowers, beyond purely collector&#8217;s use.Furthermore, the certification attesting the THC and CBD values \u200b\u200bcan be produced by any laboratory accredited by the European Union and, not only, by one &#8220;made in Italy&#8221;, as many claim.<\/p>\n<h2><strong>Is cannabis legal for the consumer?<\/strong><\/h2>\n<p>The consumer, on the other hand, can purchase it for collecting purposes. the &#8220;ius&#8221; exercised by the collector is strictly linked to the THC and CBD values \u200b\u200breported on the purchased package, which in turn are certified and guaranteed by the seller. The latter are the only weapon that protects him from the risks he could incur if an inspection were carried out.In some ways, all this brings with it hypocrisy and enormous confusion both for those who produce and sell it, and for those who buy the inflorescences. An objective fact remains: law 242\/2016 is a great demonstration of foresight on the part of our country, even if the risk remains that of remaining trapped between the meanders of moralism and false conscience.Certainly, the State must guarantee its police forces, to help them carry out their daily activities in a serene way, and all citizens a commitment towards overcoming this &#8220;vacatio&#8221; with a view to an increasingly transparent and coherent market.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Is Cannabis legal in Italy?
